Guarantee
Your Guarantee
By this Guarantee, Sony Entertainment Robot Europe, a division of Sony Service Centre (Europe) N.V. based at Da Vincilaan 7, D1 B-1935 Zaventem, Belgium (“Sony”) warrants this AIBO hardware product (the “Product”) to be free from defects in materials and workmanship for a period of 1 (one) year from the date of its original purchase.
If during this period of Guarantee the Product proves defective due to defective materials or workmanship, Sony will, (through the service option(s) notified from time to time), without charge for labour or parts, at its sole discretion, repair or replace the Product or its defective parts upon the terms and conditions set out below.
Repair or replacement of a defective Product or parts as provided in this section is your only and exclusive remedy for a defective Product, and is subject to the terms in this Guarantee.
This Guarantee does not affect your statutory rights under any applicable law in force, or your contractual rights arising from a sale and purchase contract for the Product.
You may assert your rights at your sole discretion.
Conditions and Exclusions
Free-of-charge services under this Guarantee will only be provided if the original invoice or sales receipt (indicating the date of purchase, product and seller’s name) is presented together with the defective Product within the one year period stated above.
Sony reserves the right to refuse the free-of-charge guarantee services if the date of purchase of the Product cannot be proven or if a claim is made outside the Guarantee period.
This Guarantee will not apply (and free-of-charge services will not be provided) if the manufacturer’s serial number has been altered, deleted, removed or made illegible.
This Guarantee covers only the hardware components packaged with the Product.
Further, this Guarantee does not cover any software delivered with or pre-loaded on or pre-installed in the Product.
Any such software is provided “as is” and Sony excludes all warranties express or implied in respect of any software contained in or provided with the Product unless expressly provided for in any accompanying software warranty or guarantee, any end-user licence agreement or other document expressly relating to software included with the Product (if any).
Please refer to the software manufacturer’s guarantee, if any, provided with the Product for your rights and obligations with respect to any software.
This Guarantee covers none of the following: (a) periodic maintenance and repair or replacement of parts due to normal wear and tear; (b) any consumable supplied with the Product, such as batteries; (c) physical damage to liquid crystal displays; (d) cosmetic damage; (e) damage to or loss of any software programs, data, or removable storage media; (f) any damage resulting from adaptations, changes or adjustments which may have been made to the Product without the prior written consent of Sony.
Further, this Guarantee does not cover damage due to the following: (a) misuse or improper operation or maintenance, including but not limited to failure to use the Product for its intended purpose in accordance with Sony's instructions on proper use and maintenance; (b) installation or use of the Product in a manner inconsistent with the technical or safety standards in the countries of the European Union, Switzerland and Norway; (c) connection to improper voltage supply; (d) use of the Product in conjunction with third party accessories, products or ancillary or peripheral equipment; (e) attempted repair by any party other than one authorised by Sony; (f) accidents, lightning, water, fire or any other cause beyond the reasonable control of Sony; (g) abuse, neglect or commercial use.
This Guarantee does not cover technical assistance or support for Product use, including hardware or software use.
Available assistance and support (if any) and charges and other terms of assistance and support (if any) will be specified in the documents delivered with the Product.
Before any services are provided hereunder on the Product, you must ensure that you back up the contents of your Product, including any data you have stored or software you have installed on the Product.
Sony shall not be responsible for any damage to or loss of any programs, data, or other information stored on any media or any part of any Product serviced hereunder.
Sony shall not be liable for the consequence of such damage or loss, including business loss, in the event of system, program or data failure.
It is your responsibility, prior to servicing, to remove all features, parts, options, alterations, and attachments not covered by this Guarantee prior to releasing the Product to Sony.
Sony shall not be liable for any loss or damage to these items.
If during the repair of the Product any data or software is altered, deleted, or in any way modified, Sony shall not be liable whatsoever.
The Product will be returned to you configured as originally purchased, subject to availability of software.
Where Sony elects to replace a Product or parts, repair parts and replacement Products will be provided on an exchange basis and will be either new, equivalent to new or reconditioned.
All replaced parts and Products become the property of Sony.
The period of guarantee for any Product or part repaired or replaced hereunder shall be the balance of the original guarantee period of the Product, or 3 (three) months from such repair or replacement, whichever is longer.
This Guarantee is valid in any country of the European Union, Switzerland and Norway.
Additional Exclusions
Without limiting the exclusions above, Sony shall not be liable for any incidental or consequential damages or other damages, or loss of profits, loss of revenue, loss of data, loss of use of the Product or any associated equipment, downtime and user time or for breach of any express or implied warranty, breach of contract, negligence, strict liability or any other legal theory related to the Product.
Except to the extent prohibited by applicable law, any implied warranty of quality or fitness for a particular purpose on this Product is limited in duration to the duration of this Guarantee.
Additionally, some countries do not allow the exclusion or limitation of incidental, consequential or specified other damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply, or may not fully apply to you.
